السؤال : إذا حكم للبنك بفوائد تأخير من المحاكم فهل يجوز للبنك أن يضمها إلى أمواله؟

الجواب : لا فرق بين الحصول على غرامة التأخير عن طريق الاشتراط في العقد أو عن

طريق الحكم القضائي ويجب في الحالتين صرفها في الخيرات والله أعلم .

No. Even in such a case, the amount obtained must be spent for charitable purposes, after deducting the actual losses incurred by the Islamic bank.
